1.In compliance with the information obligations set forth in art. 52, paragraph 1, letters (f) and (g) of the Consumer Code, point no. 5.2 and following indicate the terms and conditions that govern the right of withdrawal in favor of the Customer, as regulated by the same Consumer Code.

 

2. In accordance with the provisions of the Consumer Code, the Customer has the right to withdraw from the Contract, according to the methods and timeframes set out in this Section.

 

3. If the Customer intends to exercise the right of withdrawal, he/she must send a specific communication (without the need to specify any reasons) within 14 (fourteen) working days from the day of receipt of the Product, to be sent by registered letter with acknowledgement of receipt, or by fax or e-mail provided that it is confirmed by registered letter with acknowledgement of receipt within the following 48 (forty-eight) hours, to the address indicated below: DEMO RICAMBI AUTO SRL, Via Rosmini 62/A – 95014 Giarre (CT), in which the intention to withdraw is evident, clearly indicating:

• Original document (indicate the invoice number and date);

• In case of partial withdrawal, indicate the code of the item or items;

• Bank details to which the refund transfer can be made

• (IBAN – ABI – CAB – account of the document holder).

 

4. In case of exercising the right of withdrawal, the Customer will be required to return the Product to DEMO RICAMBI AUTO SRL, Via Rosmini 62/A – 95014 Giarre (CT).

 

5. The exercise of the right of withdrawal entails for the buyer the obligation to return the products received, complete with all accessories and in their original packaging, with all seals and intact wrappings.

 

6. The return of the material must be carried out at the expense of the buyer as soon as possible and in any case no later than 30 days after the written communication of the intention to exercise the right of withdrawal.

 

7. If the Customer has exercised the right of withdrawal in accordance with the provisions of these General Conditions of Use and Sale, DEMO RICAMBI AUTO SRL will, within 30 working days from the day of receipt of the returned goods, refund the Customer the amount paid net of shipping costs.

 

8. The risks associated with the destruction or damage of the products during shipping are borne by the Customer, it being understood that in such an eventuality, the products will not be considered intact. DEMO RICAMBI AUTO SRL will inform the customer of the incident (within 5 working days of receiving the goods in its warehouses), to allow him to promptly file a complaint against the courier chosen by him and obtain reimbursement of the value of the goods (if insured); in this eventuality, the product will be made available to the customer for its return, simultaneously cancelling the request for withdrawal.
